Aims of the course:

Our seminar will highlight the key features of the case and provide guidance on how the decision will influence Extension of Time claims and the treatment of concurrent delay.

Topics covered:

    Concurrent Delay - How will it affect you?

    A recent Scottish Inner House decision has helped clarify how concurrent delays should be dealt with under the Extension of Time provisions of the JCT Contract, and as a result  provided direction on the operation of other contracts. The three man panel found that a “common sense” approach should be used when assessing Extension of Time claims and there should be apportionment of responsibility for concurrent delays where neither delay is dominant.
