Concurrent Delay - How will it affect you?
A recent Scottish Inner House decision has helped clarify how concurrent delays should be dealt with under the Extension of Time provisions of the JCT Contract, and as a result provided direction on the operation of other contracts. The three man panel found that a “common sense” approach should be used when assessing Extension of Time claims and there should be apportionment of responsibility for concurrent delays where neither delay is dominant.
